Terms of Service

These Terms of Service ("Terms") are an agreement between you and Odd Circuit Games ("we", "us") governing your use of oddcircuitgames.com (the "Site") and the mobile games we publish (each a "Game"), including Aero: Arrow Puzzle Escape and any other game we release under the Odd Circuit Games name. A current list of our Games is available on our Games page.

By using the Site, or by downloading, installing or playing a Game, you agree to these Terms. If you do not agree, please do not use them.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play our Games on devices you own or control, for your own private, non-commercial entertainment.

We keep all rights we do not expressly grant. Our Games and Site - including their code, artwork, sounds, level designs, names and logos - remain our property and are protected by copyright and other laws.

2. What you may not do

You agree not to:

• Copy, sell, rent, sub-licence or otherwise distribute our Games
• Reverse-engineer, decompile or disassemble a Game, except to the extent that applicable law expressly permits it despite this restriction
• Modify a Game, or use cheats, automation, bots or modified clients to alter gameplay
• Interfere with advertising, or attempt to generate fraudulent ad impressions or clicks
• Use the Site or a Game in any way that breaks the law or infringes anyone's rights

3. Virtual items and in-game currency

Some of our Games include virtual coins or currency and cosmetic items (such as themes, skins or sound packs), which can be earned through play and, in some Games, purchased (see section 4). Not every Game includes virtual items; where a Game does, this section applies to them.

Virtual items are not your property and have no monetary value. Specifically:

• They are a limited licence to use a feature within the Game - nothing more
• They cannot be exchanged for real money, goods, or anything of value outside the Game
• They cannot be transferred or sold to anyone else
• They are not refundable
• We may change, rebalance, or remove them, or adjust their price in coins, as part of normal game updates
• If your progress is deleted - by you, or by uninstalling the Game - any virtual items are lost and will not be restored, because we keep no copy of your progress

4. Optional purchases

Some of our Games offer optional purchases made with real money - for example, an ad-removal purchase (such as Remove Ads), or a bundle of in-game currency. Not every Game offers every kind of purchase; what is actually on offer in a given Game is described in that Game's store listing and in-game shop.

What an ad-removal purchase gets you: where a Game offers one, full-screen advertisements between levels stop appearing, permanently, on any device where you are signed in to the Google account that made the purchase.

What it does not do: an ad-removal purchase does not remove rewarded ads - optional ads you choose to watch in exchange for a hint, a heart refill, or another in-game benefit. Those remain available, because they are something you opt into for a benefit rather than an interruption. An ad-removal purchase also does not grant coins, hints, or any other in-game item unless the Game's store listing says otherwise.

Payment and refunds: every purchase is sold and processed by Google Play, not by us. It is subject to the Google Play Terms of Service and Google's refund policy. Refund requests must be made through Google Play. Where you have a statutory right to cancel or a refund under your local consumer law - including the 14-day right of withdrawal for EEA and UK consumers - that right is unaffected by these Terms.

Restoring: a purchase is tied to your Google account. Use Settings → Restore Purchases after reinstalling or on a new device. Using Settings → Delete My Data clears local progress and the local record of a purchase, but does not cancel the purchase - restore it at any time.

We may change prices, or stop offering a purchase to new customers, at any time. Doing so does not affect a purchase you have already made.

5. Advertising

Our Games are free and funded by advertising. By using them you accept that advertisements will be shown, including full-screen ads between levels and optional rewarded ads you can choose to watch in exchange for an in-game benefit. In Games that offer an ad-removal purchase, full-screen ads between levels can be removed that way (section 4).

Ads are supplied by Google AdMob. We do not control which specific ads are shown, and we are not responsible for the content of third-party advertisements or for anything you obtain from an advertiser. Any dealings you have with an advertiser are between you and them.

6. Your data

Your use of the Site and our Games is also governed by our Privacy Policy, which forms part of these Terms. In summary: our Games store your progress only on your own device, and we hold no account for you. Google services built into our Games - advertising, analytics and crash reporting, and Google Play Games if you choose to sign in - do send some information to Google. What they collect, and how to turn off what is optional, is set out in the Privacy Policy.

Your game progress is your responsibility. We keep no backup and cannot restore lost progress - including progress lost through deleting a Game's data, uninstalling, losing or resetting your device, or a device fault.

Google Play Games is optional. You may choose to connect a Game to Google Play Games. Doing so is subject to Google's own terms, and your Play Games profile is managed by Google, not by us. You can stop a Game using Play Games at any time from Settings; that does not delete anything Google holds, which you manage through your Google account. Nothing in our Games requires you to sign in.

7. Updates and availability

We may update, change or discontinue the Site or a Game, or any of their features, at any time. We may also stop supporting older versions or older devices. Everything is provided as-is, and we do not promise it will always be available, uninterrupted or error-free.

8. Age requirement

Our Games are intended for players aged 13 and over. By using them you confirm you are at least 13. If you are under the age of majority where you live, you confirm that your parent or guardian has reviewed and agreed to these Terms on your behalf.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Site and our Games are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that a Game will meet your requirements, or that it will be uninterrupted, secure, or free of errors.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, virtual items, profits or goodwill, arising from your use of or inability to use the Site or a Game.

Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 10.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. If you are a consumer in the EEA or UK, you keep all mandatory statutory rights, and nothing here affects them.

11. Termination

You may stop using a Game at any time by uninstalling it.

We may suspend or end your licence to use a Game if you materially breach these Terms - for example by cheating or by interfering with advertising. On termination, the licence in section 1 ends and you must stop using the Game. Sections 3, 6, 9, 10 and 12 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of India will have jurisdiction over any dispute.

If you are a consumer resident in the EEA or the UK, this does not deprive you of the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in your local courts. EEA consumers may also use the European Commission's Online Dispute Resolution platform.

13. Changes to these Terms

We may revise these Terms as our Site and Games develop. The "Last updated" date above shows the current version, and material changes will be announced in the Game or its store listing. Continuing to play after a change means you accept the revised Terms.

14. General

If any provision of these Terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site and our Games.

Our Games are distributed through Google Play. Google is not a party to these Terms and has no responsibility for them.
